回应型司法视野下认罪认罚案件被告人上诉权研究

摘　　要：伴随着中国刑事诉讼模式的逐步转型,认罪认罚从宽制度经历了从试点探索到正式确立的过程。面对被告人认罪认罚之后提出上诉的难题,从契约精神、诚实信用、公正效率到司法公信力的角度,都无法给予回应与解答。基于协商民主理论与实践,运用回应型司法理念,通过保障协商参与者的主体性地位,实现对司法过程的实质性参与,以沟通对话、凝聚共识,成功找到“司法的最大公约数”,就能够妥善平衡诉讼价值的冲突与矛盾,积极回应社会需求,有效解答司法难题。With the gradual transformation of China's criminal procedure model,the leniency system of guilty plea has gone through the process from pilot exploration to formal establishment.Facing the difficult problem of appeal after the defendant confesses guilt and receives punishment,we cannot give a response from the perspectives of the spirit of contract,honesty and credit,justice and efficiency,and judicial credibility.Adopting the theory and practice of deliberative democracy,using the concept of responsive justice,and aiming at guaranteeing the subjective status of the participants in the consultations,the substantive participation in the judicial process can be realized through communication and dialogue for consensus in hope of successfully finding“the greatest common denominator of judicature”,which can properly handle the conflict and contradiction in litigation for a good value orientation,positively respond to the needs of the society,and effectively solve the judicial difficulties.
