摘　　要：随着《国务院关于授权和委托用地审批权的决定》的印发,我国以新增建设用地管控为核心的用地审批制度的事权配置进一步明晰,但存量建设用地审批的制度设计相对滞后。文章基于土地发展权视角,梳理我国土地开发及利用过程中各级政府用地审批的事权配置,分析国土空间规划中用地审批制度建立的任务与面临的困境,并结合广州城市更新用地报批实践,探讨国土空间规划中存量建设用地审批的制度设计及审批策略,提出存量建设用地的审批应基于公平与效率原则,明确土地确权规则;应基于国土空间规划管控要求,分类配套相应用地审批政策;各级政府应在其权责范围内,强化联动审批机制,处理好放权、协同、聚合的关系。As the state council issues The Decision of Authorizing Land Use Inspection and Approval Power,the configuration of new construction land use inspection and approval power is getting clarified whereas stock land institutional design is lagging behind.Based on land development right,the paper reviews the configuration of land use inspection and approval rights at different levels in the government,analyzes relevant missions and dilemmas in national territory spatial planning,and studies the institutional design of stock land inspection and approval.It proposes that stock land inspection and approval shall clarify land right specification rules based on equity and efficiency;configure correspondent land use policies under national territory spatial governance requirements;strengthen interactive mechanism and deal with decentralization,coordination,and concentration of powers within the responsibilities of different level governments.
