高校开展专利申请前评估的必要性与可行性研究

摘　　要：目前,国内高校专利申请和授权量大幅提高,但高价值专利缺乏,有效专利转化运用不理想,最主要的原因是大多数高校专利质量不高。专利申请前评估与专利查新检索、专利实质审查紧密联系,但又有较大的区别,其最终目标是减少无效申请和低质量专利的数量,提升专利质量,提高专利实施率。各高校应该联合起来,在国家政策的指引下,借鉴国外相关案例与经验,充分发挥各校的学科与人才优势,利用好相关知识产权服务机构的力量,构建起国内高校专利申请前评估的体系与机制,全面推进高校专利申请前评估工作。At present,the number of patent applications and authorizations in colleges and universities has increased significantly,but there is a lack of high-value patents and the transformation and application of effective patents is not ideal.The main reason is the low quality of patents in most colleges and universities.Patent pre-application assessment is closely related to patent novelty search and patent substantive examination,but there are great differences.Its ultimate goal is to reduce the number of invalid applications and low-quality patents,improve patent quality and improve patent implementation rate.Colleges and universities should unite,under the guidance of national policies,learn from relevant foreign cases and experience,give full play to the discipline and talent advantages of colleges and universities,make good use of the strength of relevant intellectual property service institutions,build a system and mechanism for patent pre-application assessment of universities,and comprehensively promote the patent pre-application assessment of colleges and universities.
