摘 要:2019年新《土地管理法》打破了我国集体经营性建设用地入市的法律障碍,完善了土地征收补偿的标准和程序,对废除征地垄断供应模式、实现同地同权具有里程碑意义。但在新的法律中,征地补偿制度与建设用地入市制度的衔接,区片综合地价的制定以及征地纠纷的司法救济等问题仍有待解决。美国、台湾等地的征地制度改革探索较早,其中公平市场价值理论和重置成新补偿法对我国征地补偿制度的完善具有积极的启示作用。In 2019,the new Law of the People’s Republic of China on Land Administration broke the legal barriers of collective-owned construction land marketization,and improved the standards and procedures of land expropriation compensation,which was a milestone for abolishing the monopoly supply mode of land expropriation and realizing the same right of the same land.However,in the new law,there are still some problems to be solved,such as the convergence of land expropriation compensation system and construction land marketization system,the formulation of regional comprehensive land price and judicial relief for land acquisition disputes.The reform of land expropriation in the United States and Taiwan Province has been explored earlier,among which the fair market value theory and the reset to new compensation price have positive enlightenment on the improvement of land expropriation compensation system in China.
