摘　　要：21世纪以来,中国对外直接投资快速发展,海外投资风险也逐渐显现。特别是受中美贸易摩擦、新冠疫情的影响,各国保护主义抬头,我国企业海外投资风险也随之增加。海外投资担保被认为是防范海外投资风险最有效的措施之一,特别是世界银行集团中的多边投资担保机构(MIGA),作为全球最具影响力的国际投资担保机构,为保障各国海外投资权益发挥了重要作用,受到多数资本输出国的广泛认可及应用。然而,我国对外投资企业尚未充分认识到海外投资担保的重要性,对MIGA担保的利用率极低,这与中国企业海外投资的整体规模与快速发展趋势并不相称。为此,文章在深入分析MIGA担保机制创新与价值的基础上,针对我国企业如何应用MIGA担保机制保障海外投资权益提出了对策建议。Since the beginning of the21 st Century,China has experienced rapid growth in foreign investment and risks related thereto.The ongoing Sino-US trade friction and COVID-19 pandemic have led to a burst of protectionism,which has increased risks for foreign investments.International investment guarantee has been recognized as one of the most effective measures to prevent investment risks.The Multinational Investment Guarantee Agency(MIGA),a member of the World Bank Group,is one of the most influential international investment guarantee agencies in the world,has helped countries to protect foreign investment from risks,and therefore been widely recognized and accepted by most of the capital exporting countries.However,Chinese enterprises have neither comprehend the importance of international investment guarantee nor put MIGA to good use,which is out of proportion to the scale and trends of their overseas investment.This study was conducted to illustrate the innovation and significance of the rules and policies of MIGA,and advices for Chinese enterprises on how to apply MIGA.s guarantee for protection from interventional investment risks.
