食品安全风险治理之行政程序研究——以“第三代”行政程序的兴起为线索

摘　　要：在现代风险社会背景下,食品安全风险呈现多元复合性特征,给食品安全风险治理带来严峻挑战。正当行政程序在现代风险治理中具有重要功能。然而,传统行政程序因其高度的封闭性、对抗性、个别化等特征,难以回应现代风险规制的开放性、合作性、多元性和过程性,而陷入合法性危机之中。"第三代"行政程序所具有的开放性、过程性和协商性特征,能够回应食品安全风险行政的现实需求。有鉴于此,我国食品安全行政程序的建构应当吸收"第三代"行政程序的基本理念,基于食品安全风险的属性特征,以多阶性、参与性和协商性作为食品安全行政程序变革的方向,围绕着食品安全风险治理框架,建立起食品安全风险行政程序的核心建制。Under the background of modern risk society, food safety risk presents multiple and complex characteristics, which brings severe challenges to traditional food safety risk. Proper administrative procedure has an important function in modern risk administration. However, the traditional administrative procedure is difficult to respond to the characteristics of openness, cooperation, pluralism and process of modern risk regulation due to its highly closed, antagonistic and individualized characteristics, and fall into the crisis of legitimacy. Because of its openness, process and negotiation, the "third generation" administrative procedure can respond to the actual needs of food safety risk administration. In view of this, the construction of food safety administrative procedure in China should absorb the basic idea of the third generation of administrative procedure, based on the attribute characteristics of food risk, take multi-level, participatory and consultative as the direction of food safety administrative procedure reform, and establish the core system of food safety risk administrative procedure around the framework of food safety risk governance.
