滇南彝族习惯法与当今国家成文法关系调适

摘　　要：民族习惯法是民族社会成员共同恪守和遵循的道德意识和行为准则,是人类社会进程中约定俗成的道德规范。滇南彝族社会生活中,还传承和盛行着全民共同恪守和遵守的习惯法,如婚姻、生产生活以及惩处、继承等多种习惯法。这些习惯法有的与国家现行成文法大相径庭,甚至相悖,有的则与国家成文法如出一辙,同工异曲。充分挖掘和研究滇南彝族习惯法中积极向上的文化价值和社会功能,对滇南彝族乡村自治、法治、德治的综合治理和乡村振兴战略有着积极的作用。National customary law is the moral consciousness and code of conduct that members of the national society adhere to and follow,and it is a customary moral standard in the long course of the develop⁃ment of national human society.In the social life of the Yi people in southern Yunnan,a variety of customary laws,such as marriage,production and life,as well as punishment and inheritance,are inherited and preva⁃lent.Some of these customary laws are very different from and contradictory to the existing statutory laws of the state,while others are the same as the current statutory laws of the state.Therefore,it is necessary to give full play to the cultural values and social functions of the Southern Yunnan Yi people’s customary law,play⁃ing an active role in the comprehensive governance of the southern Yunnan Yi people’s rural autonomy,rule of law,rule of law and rural revitalization strategy.
