On Integration of Power of Arrest and Prosecution

摘　　要：新一轮司法体制改革引出检察机关把侦查监督部门与公诉部门合为一体的改革思路。这种改革涉及到法律赋予检察机关的逮捕权与公诉权在内部的重新配置,以及检察权运行机制的变化。逮捕权与公诉权由同一个主体行使,并没有改变诉讼程序,没有减少诉讼环节,因而也没有违背这两种权力应当分别行使的原理,反而更有利于加强对侦查活动的监督制约,更有利于对人权的保障,更有利于整合检察资源,提高诉讼效率。问题在于,捕诉一体之后,应当坚持捕诉一体的理念,机构调整与职能整合并进;按照捕诉一体的要求,改革办案模式;遵循捕诉一体的规律,改革检察业务考评机制;完善监督制约机制,以便保障捕诉一体制度改革的顺利进行。The new round of judicial system reform leads to the reform idea that the procuratorates should combine the investigation supervision departments with the public prosecution departments.This reform involves the internal reconfiguration of the arresting power and the public prosecution power entrusted to the procuratorates by law,as well as the change of the operation mechanism of procuratorial power.Such combination actually does not change the proceedings,not reduce litigation link,and therefore did not violate the principle of the separation of power principle.On the contract,it is beneficial to strengthen the supervision of investigation activities,is more advantageous to the human rights safeguard,more conducive to the integration of procuratorial resources and improve the efficiency of lawsuit.The problem lies in that after the integration,the concept of integration of arrest and prosecution should be adhered to,and institutional adjustment and functional integration should be improved.We should also reform the mode of handling cases according to the requirements of integrating arrest and prosecution;follow the law of the integration of arrest and prosecution to reform the procuratorial professional work evaluation mechanism;and perfect the supervision and restriction mechanism,in order to ensure the smooth progress of the reform of the integration of arrest and prosecution system.
