摘 要:诉讼是国家建立的纠纷解决机制,但它遗传了战争和决斗的制度基因。如果向前追溯人类解决纠纷的历史,就会发现诉讼和战争是同源的。以会战替代全天候战争,或以决斗替代复仇,都会降低冲突的规模和烈度,这和以诉讼取代决斗是同样的道理。第三方的介入可以抑制双方的冲突,并且介入冲突会让第三方从中获益。诉讼制度的每一个支撑部分都能在历史上找到它的前身,追溯这些前身可以让我们更好地理解诉讼。Litigation is a dispute resolution mechanism established by the state.However,some of the elements in the litigation mechanism were the legacies of the institution of war and duel.If we trace back the history of human dispute resolution,we will find that litigation and war are homologous.Substituting all-out wars with regional decisive battles or substituting vengeance with duels can both bring down the scale and ferocity of conflicts,which conforms to the same logic behind the substitution of litigation for duel.The involvement of a third party could restrain conflicts and it could gain benefits from its involvement.Each pillar that underpins the litigation system has its origin dating back to history.Knowing how they have evolved could help us better understand the litigation mechanism.
