“还权赋能”视角下宅基地制度改革增加农民财产性收益的路径研究

摘　　要：农村宅基地是农民重要的生产资料,也是实现财产性收益增加的重要来源。2019年修正的《中华人民共和国土地管理法》(以下简称《土地管理法》)鼓励盘活利用闲置宅基地和闲置住房,但实践中迫切需要厘清产权,明晰功能,探索通过宅基地制度改革实现农民财产性收益增加的可行路径。在梳理中国部分地区宅基地改革实践做法的基础上,提出"还权赋能"视角下宅基地自营、抵押、流转和退出四条实现财产性收益增加的路径,明确了各路径的适用条件和配套措施,指出了不同发展阶段地区因宅基地资产功能、保障功能的侧重不同而运用不同的路径,并就实施过程中政府职能的完善提出政策建议,为推进农村宅基地制度改革工作提供借鉴和参考。Rural homestead is an important means of production for farmers and an important source of increasing property income.In the process of homestead system reform,it is urgent to clarify property rights,clarify functions,and explore a feasible path to increase farmers'asset-income through the reform of homestead system.Based on the practice of homestead reform in some areas of China,this paper proposes four ways to increase property income from the perspective of"property rights delineation",namely,self-operation,mortgage,circulation and withdrawal of homestead.At the same time,this paper also puts forward some policy suggestions on the improvement of government functions in the process of homestead system reform,which can provide reference for promoting the reform of homestead system in rural areas.
