摘　　要：精神病人肇事肇祸严重危及社会秩序与民众生命、财产安全,在外力管控的常规路径下,面对依然未被根本遏制的精神病人危害行为,本文从实证角度出发,以危害对象、危害特征及危害客体为标准,在对精神病人危害类型进行全面剖析的基础上,详细厘定此类主体肇事肇祸的内外诱因,进而立足于社会防卫与权利保障兼顾与平衡的价值遵循,探索危害防控机制的原则与标准,通过阐述经济补助、知情与自决等权利内涵,搭建精神病人危害防控中的权利体系框架,以期消弭精神病人肇事肇祸的内在诱因,重塑精神病人危害防控新模式。The harms of lunatics to social order and the public’s life and property security could hardly be ignored in the present days.As for the uncontrolled or uncontained lunatics’harmful behaviors,this paper,from the angle of empiricism,conducts an overall analysis of the victims,harm features and suffered objects as well as the relevant internal and external causes and the prevention and control principles and standards.It is argued that through economic compensations,informing and self-decision,we could formulate a framework of rights for the prevention and control of lunatics’harms,reduce the internal causes for lunatics’harmful acts,and reshape the“new space”for keeping lunatics off harm practicing.
