软法律家长主义视角下就业协议中高校角色的转变

摘  要:大学生就业协议制度的完善虽然取得一定的进展,但是有关大学生就业协议的性质仍存在争议。因而"因就业协议而产生的纠纷"应当适用何种法律、寻求何种机关的帮助等问题也变得复杂。高校在就业协议中职能的定位对确定大学生就业协议书的性质具有关键意义。而软法律家长主义为此提供一个很好的切入视角。在依法治教的背景下,高校在就业协议制度中的角色应当转变。大学生就业协议的性质应当被认为预约合同。同时,应加强高校的就业教育和签约阶段的就业法律服务。Although the improvement of the college student employment agreement system has made some progress,the nature of the employment agreement is still controversial.Therefore,what laws that"disputes arising from employment agreements"should apply and what help they seek have become complicated.The orientation of universities in employment agreement is crucial to determining the nature of employment agreement.Soft legal paternalism provides a good entry perspective.Under the background of governing education according to law,the role of universities in the employment agreement system should be changed.The nature of the college employment agreement should be considered an appointment contract.At the same time,we should strengthen the employment education of colleges and universities and the contracted stage of employment legal services.
