摘  要:法律诊所教育模式因法律援助制度的出现而产生,蕴涵着公益文化基因,因而与社会创业活动紧密相关。社会创业教育伴随着经济市场化和社会多元化的趋势而产生和发展,其发展过程中又受到善治理念的影响。法律诊所教育和社会创业教育相依而生又相伴而兴的发展历史为两者融合发展提供了历史逻辑,即坚持独立发展和注重相互借鉴相统一;价值内涵的共通性与实现机制上的互补性,为两者融合发展提供了理论逻辑,即坚持公益价值取向和借鉴商业机制相统一;路径选择的实践性和方法选择的创新性为两者融合发展提供了现实逻辑,即坚持实践导向和注重思维创新相统一。Due to the emergence of the legal aid system,the legal clinic education model contains the gene of public welfare culture,so it is closely related to social entrepreneurial activities.Social entrepreneurship education is produced and developed with the trend of economic marketization and social diversification,and its develop⁃ment process is affected by the concept of good governance.The history of the development of legal clinic educa⁃tion and social entrepreneurship education provides a historical logic for their integrated development,that is,to adhere to the unity of independent development and mutual reference.The commonality of value connotation and the complementarity of realization mechanism provide theoretical logic for the integration and development of the two,that is,to adhere to the unity of public welfare value orientation and business mechanism.The practi⁃cality of path selection and the innovation of method selection provide practical logic for the integrated develop⁃ment of the two,that is,the unity of adhering to practice orientation and paying attention to thinking innovation.
