行政复议法的主渠道定位

摘　　要：行政复议的主渠道定位,是对行政复议作为积极能动型监督和救济机制的强调,同时意味着行政复议应当实质、及时、公正地化解行政争议。这一定位为《行政复议法》的修改和行政复议制度的完善提供了方向性指引。《行政复议法》的修改应当在争议问题达成共识的基础上精细安排解决方案。完善中国特色行政复议法制创新路径,应当注意构建公益行政复议制度和行政复议指导案例制度,强化行政复议的支持和指导功能,并为后续行政复议法制改革提供合法性支撑和试验空间,以及择机推行复议场地科学便民温情化、加强复议专职队伍建设、增设公开开庭审理规范要求等改革。Positioning administrative reconsideration as the main channel,is to emphasize the feature of administrative reconsideration as an active supervisory and relief mechanism,implying that administrative reconsideration should resolve administrative disputes in a substantive,timely and fair manner.This positioning provides directional guidance for the revision of the Administrative Reconsideration Law and the improvement of the administrative reconsideration system.The amendment of the Administrative Reconsideration Law should finely arrange the solution on the basis of the consensus on controversial issues.To improve the innovation path of the administrative reconsideration system with Chinese characteristics,we should pay attention to the construction of the public interest administrative reconsideration system and the administrative reconsideration guidance case system,strengthen the guidance function of administrative reconsideration,and provide legitimacy support and test space for the subsequent reform of the administrative reconsideration legal system,as well as opportunistically implement reforms such as the determination of the reconsideration venue based on science,convenience and humanistic concern,the construction of a full-time team for reconsideration,and the formation of the standard requirements for public hearings.
