《民法典》视域下居住权制度的理解与适用研究

摘　　要：居住权作为我国《民法典》新增的一项制度,是对社会弱势群体关于房屋居住权益迫切需要的直接回应。现行《民法典》中居住权存在居住权人的类型与范围模糊、居住权制度的客体有待深化、居住权设立方式和程序不够完善、居住权设立主体与权利人权利义务亟待明晰、居住权消灭规定单一等问题。通过提出明确居住权人的类型与范围、深化居住权制度的客体、完善居住权制度设立方式与程序、明晰居住权设立主体与权利人权利义务、细化居住权制度消灭事由等建议,以期完善居住权制度的理解与适用。As a newly added system in Civil Code of the People's Republic of China,the right of residence is a direct response to the urgent needs of social vulnerable groups for housing rights and interests.However,there are some problems in the right of residence,such as the type and scope of the right of residence is vague,the object of the right of residence system needs to be deepened,the way and procedure of the establishment of the right of residence is not perfect,the rights and obligations of the subject of the establishment of the right of residence and the right holder need to be clarified,and the provisions on the elimination of the right of residence are single.By clarifying the type and scope of the right of residence,deepening the object of the right of residence system,improving the way and procedure of the establishment of the right of residence system,clarifying the rights and obligations of the subject of the establishment of the right of residence and the rights and obligations of the right of residence,detailing the causes of the elimination of the right of residence system and so on,the author hopes to improve the understanding and application of the right of residence system.
