摘 要:In the context that the mortgage has been set up on commodity housing, article 406 of the Civil Code of China does not ease the tension between the mortgage and the claims of consumers involved. Although there is room for discussion about the legal basis for the protection of the consumer’s interests in article 29 of the Judicial Interpretation No. 21, the adjudication rules established are practically applicative, considering that under the constraints of society, the consumers need special attention. In order to balance the benefits between the mortgagees and the consumers, when following article 29 of the Judicial Interpretation No.21, we shall operate prudently in accordance with the requirements of the Judicial Document No. 254 of the Supreme People’s Court.在开发商销售的商品房已经设立抵押权的情形,抵押权与商品住房消费者债权之间的紧张关系并未因为《民法典》第406条的规定得到消解。虽然最高人民法院《执行异议和复议规定》第29条侧重商品房消费者利益保护之依据不无商榷余地,但是在现实社会的约束下,商品房消费者的确需要特别关照,司法解释确立的裁判规则仍有适用的余地。为平衡抵押权人和商品房消费者之利益,在适用该司法解释时,应按照"九民会纪要"要求审慎作业。
