论行为保全法理在人格权侵害禁令中的适用——基于解释论的视角

摘　　要：人格权侵害禁令是制止侵害行为的及时性权利保护方法。人格权侵害禁令案件应当参照适用行为保全程序。遵循法律解释的方法,行为保全具有对合法权益进行保护的目的,因而获取了独立于诉讼的程序地位。为满足权利及时保护的紧迫需求,行为保全的设计应以提高程序效率为目标。因此,行为保全的程序品质与人格权保护方法所彰显的全面性、预防性和及时性相契合。在人格权侵害禁令案件中,要结合人格权保护和行为保全程序的特点,运用利益衡量的方法判断行为保全的适用要件。审理程序应以采用听审主义为原则,排除听审主义为例外。人格权侵害禁令的法律效力具有终局性和临时性两种情况。人格权侵害禁令申请错误的,申请人不应承担赔偿责任。The injunction of personality rights is a procedural protection method for right to stop infringements.Personality rights injunction cases should applicate behavior preservation procedures.Following the method of legal hermeneutics analysis,behavior preservation has the purpose of preventive protection of legitimate rights,thus gaining a independent procedural status from litigation.In order to meet the urgent need for preventive protection of rights,the design of behavior preservation aims to improve the efficiency of the procedure.Therefore,the procedural quality of behavior preservation is consistent with the comprehensiveness,prevention,and timeliness demonstrated by the protection methods of personality rights.The trial of personality rights injunction cases should combine the characteristics of personality rights protection and behavior preservation procedures,and use the method of interest measurement to determine the applicable requirements.Constructing the trial procedure is based on the principle of adopting bilateral hearing doctrine,excluding bilateral hearing doctrine as an exception.The legal effect of the injunction has two situations:final effectiveness and temporary effectiveness.If the injunction of personality rights is wrong,the applicant shall not be liable for compensation.
