面向青少年的网络短视频之监管——以比例原则为视角

摘　　要：我国面向青少年的网络短视频监管以法律为管制基础、以政府为管制主体,其价值取向政治化、监管方式制度化、监管内容日常化、处置措施多样化,行业自律起辅助作用。监管以促进青少年保护这一公共利益为目的,多以部门规章为监管手段,满足适当性原则、必要性原则,但难以经受均衡性原则的挑战,并不符合比例原则。应当以比例原则完善网络短视频监管制度,均衡分配短视频制作者和平台的责任,缓解青少年网络权利、青少年保护及成年人言论自由等价值之间的冲突。China’s Youth-oriented Online Short Video Regulation is based on the law, with the government as the main body of regulation.Its value orientation is politicized, and the way of regulation is institutionalized, and the supervision content is routine, and the disposal measures are diversified, and the industry self-regulation plays a supplementary role. The purpose of supervision is to promote the protection of the public interest of the youth, and most of them take the departmental regulations as the means of supervision, which meet the principles of appropriateness and necessity, but they can not stand the challenge of the principle of balance, so they do not conform to the principle of proportionality. The online short video supervision system should be improved based on the principle of proportion, and the responsibility of producers and platforms of short video should be distributed in a balanced way, so as to alleviate the conflicts among the values of youth online rights, protection of teenagers and freedom of speech of adults.
