摘 要:不动产登记制度是不动产物权法律体系的重要组成部分。现行法律关于不动产登记制度的规定并不完善,且不动产登记错误所牵涉的法律关系颇为复杂,相关纠纷的解决途径也多种多样。由于不动产登记行为本身属于行政确认行为,不动产登记机构登记错误的侵权行为是违法行为,所以由不动产登记错误引发的纠纷应通过以更正登记为核心的行政救济和以行政诉讼、行政附带民事诉讼为主的司法救济等两种途径予以解决。The real property registration system is an important part in the legal system of real estate real rights,and the stipulations about the real property registration system in the existing laws are not perfect.Moreover,the legal relation triggered by real property registration error is quite complex,leading to various real property registration disputes.The real property registration behavior should be an administrative verification behavior,and the infringement act of registration authority’s registration error is illegal,and the disputes triggered should be solved through administrative remedy dominated by registration correction and judicial remedy dominated by administrative litigation and administrative litigation with incidental civil action.
