摘　　要：完善学校体育伤害事故法律规制体系对于依法处理学校体育伤害事故具有重要意义。采用文献资料法、案例分析法和逻辑分析法等研究方法,系统梳理学校体育伤害事故法律规制体系,检视现有体系存在的问题,继而提出完善策略。研究认为,我国已经形成了以《宪法》为纲领、以《民法典·侵权责任编》为基本骨架、以《学生伤害事故处理办法》为补充的学校体育伤害事故法律规制体系。该体系在立法理念、体系建设、实践执行中存在一定局限,制约了实施效果。由此提出完善策略:依法完善学校体育伤害事故损失分担机制,在《体育法》中增设学校体育伤害事故专项条款,将学校体育保险纳入立法等。Improving the legal regulation system of school sports injury accidents is of great significance to deal with these accidents legally.This paper systematically combs the legal regulation system of school sports injury accidents,as well as examines the problems containing in existing systems,and then offers improvement strategies through literature research method,case analysis and logical analysis.It shows that China has formed a legal regulation system of school sports injury accidents with The Constitution as the guiding principle,The Civil Code-Tort Liability as the basic framework and The Measures for the Handling of Student Injury Accidents as the supplement.The system has some limitations in legislative concept,system construction and practical implementation,which restricts the implementation effect.Therefore,this paper puts forward improvement strategies,such as improving the loss sharing mechanism of school sports injury accident legally,adding special provisions on school sport injury accidents into The Sports Law and bring school sport insurance into legislation.
