非羁押诉讼制度数字化转型的实践检视与前景展望——以“非羁码”为例

摘　　要：“非羁码”是非羁押诉讼制度数字化转型的代表性实践。在犯罪结构变化、诉讼制度变革和犯罪治理变迁背景下,“非羁码”的形成虽具有“应急法治”的偶然色彩,却内蕴非羁押诉讼制度的改革必然。实践证明,“非羁码”集中体现了由限权走向赋权、由单元走向系统、由粗放走向集约的数字法治前景,但也有“数字侵蚀”“数字枷锁”“数字伪造”等风险隐忧。以“非羁码”为代表的非羁押诉讼制度数字化转型应立足实际,厘清主体、规则和生态前置数字问题,秉持二元进阶路径稳步推进。The non-custody code is the representative practice of digital transformation of noncustody litigation system.Under the background of the changes of criminal structure and criminal governance structure,what’s more,reformation of litigation system,the formation of non-custodial digital supervision system has the accidental flavor of"emergency law governance",but it means the inevitability of the reformation of non-custodial criminal litigation system.The practice has proved that the non-custodial code shows the digital law governance prospect by changing the power limitation to empowerment,unit to system,extensive management to intensive one,but there are also such potential risks as"digital erosion","digital shackles"and"digital forgery".The digital transformation of noncustodial litigation system should be based on the reality,clarification of the subject,rules and ecological pre-digital issues,and adherence to the dual advanced path.
