检察公益诉讼的管辖变化及制度考量

摘　　要：检察公益诉讼的管辖制度,不仅关系到检察机关能否便捷高效的查清事实、对公益的保护力度及其实现程度,也是实现诉讼公正的技术手段。新出台的《人民检察院公益诉讼办案规则》进一步厘清了管辖制度,笔者对比规则出台前后公益诉讼管辖的变化,并阐述在构建检察公益诉讼管辖制度应当考量的因素。The jurisdiction system ofprocuratorial public interest litigation is not only related to whether the procuratorial organ can find out the facts conveniently and efficiently and how the public interest is protected and the degree of its realization,but also to the technical means of realizing the justice of litigation.The newly issued Rules for Handling Public Interest Litigation by the People’s Procuratorate further clarifies the jurisdiction system.The author compares the changes in the jurisdiction of public interest litigation before and after the promulgation of the rules,and expounds the factors that should be considered in the construction of the procuratorial public interest litigation jurisdiction system.
