摘　　要：区块链作为价值去中心化的工具、赋能万物的事实机器和可靠的自动化合约机器,可以被广泛地应用于司法领域。区块链司法应用的主要动因有:司法信息真实性需要民主化验证、司法数据安全性需要强信任环境、司法活动效率性需要技术化辅助、司法活动重复性需要可溯源机制。区块链司法应用的场景具有非中心化、强信任需求和缺乏效率等特点,分散于司法协同、信息公开与诉讼服务、审判执行辅助、司法管理与司法统计等多个业务场景之中。在区块链司法应用的实践中,应遵循以下原则:区分链型按需建设、衔接其他信息化技术、跟进配套设施建设、探索规范化治理机制、关注区块链社会应用等。区块链司法应用还要坚持正确的方法论:正识技术工具属性、因地因时融合发展、把握科技发展规律。Blockchain as a value decentralized tool and a factual machine that empowers everything,and a reliable automated contract machine,can be widely introduced into the judicial field.The main reasons for the application of blockchain to the justice include:The authenticity of judicial information needs democratic verification,the security of judicial data demands a trustworthy environment,the efficiency of judicial activities requests technical assistance,and the repeatability of judicial activities requires traceability mechanism.The scene of blockchain application in justice has the characteristics of decentralization,dependable demands and the lack of efficiency,which scattered in multiple business scenarios such as judicial collaboration,information disclosure and litigation services,trial execution assistance,judicial management and statistics.In the practices of blockchain application in justice,the following principles should be obseved:Distinguish blockchainbased ondemand construction,connect with other information technologies,follow up the construction of supporting facilities,explore standardized governance mechanisms,pay more attention to the social application of blockchain,etc.The judicial application of blockchain should also persist in correct methodology:correctly understanding the attributes of technology as a tool,integrating development according to place and time,and grasping the law of technological development.
