摘  要:“非升即走”是我国大陆地区高校聘用改革的趋势,规制解聘行为是改革的焦点问题之一。我国台湾地区依托行政契约形成独特的司法规制路径,“行政法院”依据“教师法”第14条的解聘情形,对何谓“行为违反相关法令”“教学不力或工作不能胜任”及严重违约等不确定性概念进行了个案认定,一方面形塑解聘的规范内涵,另一方面也有利于教师权利保护以及公共利益的维护。大陆地区不应放弃行政诉讼在解聘争议中的作用,可借鉴其部分经验以行政协议为接入点、借助《教师法》修订的窗口期引入行政诉讼制度,通过发挥行政诉讼的多元功能保障高校教师权益、助益解聘制度完善。The tenure system is the trend of personnel reform in colleges and universities in China's Mainland,and the regulation of dismissal behavior is one of the focuses of the reform.In Taiwan,a unique judicial regulation path based on the administrative contract is formed.According to the dismissal circumstances in Article 14 of the“Teacher Law”,the“administrative court”in Taiwan mainly identifies cases to illustrate uncertain concepts such as“behavior in violation of relevant laws and regulations”,“teaching incompetence or incompetency”,“serious breach of the contract”,which on the one hand shapes the dismissal and on the other hand is also conducive to the protection of teachers’rights and the maintenance of public interests.Chinese mainland should not give up the role of administrative litigation in dismissal disputes.Chinese mainland can learn important lessons from it,such as paying attention to administrative agreement as a point of access,and using the revision of the Teachers’Law as a window to introduce the administrative litigation system.Through the multiple functions of administrative litigation,we can protect the rights and interests of university faculty and help improve the dismissal system.
