试论国家教育考试立法的疑难问题及其解决方案

摘　　要：“国家教育考试法”调整范围的确定以及对调整对象必要的稳定性与实际不稳定性的处理是影响国家教育考试立法成败的两大疑难问题。国家教育考试的治理还存在若干核心问题亟待法律规制,国家必须立法;国家教育考试的部分改革并不影响考试立法的时机,目前即可立法。制定“国家教育考试法”,务必要严格限定国家教育考试的种类与范围;合理设定国家教育考试行政主体的管辖权;完成国家教育考试资格条件的法定化;建立国家教育考试争议的专门处理机制。The determination of the adjustment scope of the National Education Examination Law,and the treatment of the necessary stability and actual instability of the adjustment object are two difficult problems affecting the success or failure of the legislation.There are still some core problems in the governance of national education examinations,which need to be regulated by law;some reforms of the national education examinations do not affect the opportunity of examination legislation,can legislate now.To formulate the National Education Examination Law,we must strictly limit the types and scope of national education examinations;reasonably set the jurisdiction of the administrative subject of national education examinations;complete the legalization of the qualification conditions of the national education examination;build a special settlement mechanism for national education examination disputes.
