环境司法专门化背景下专家陪审员制度研究

摘　　要：为正确认定环境诉讼中的证据和事实,提高司法公信力,建议建立专家陪审员参与环境案件审理的制度。环境案件专业性、技术性和复杂性较强,专家陪审员直接参加审理,能够弥补法官环境专业知识的不足,解决环境案件审理中的技术难题,这对科学认定案件事实、有效监督人民法院审判工作,切实提升环境司法公信力具有重要意义。在借鉴知识产权审判与地方法院试点实践经验的基础上,建议建立专家陪审员参与环境案件审理的选任制度、参审制度、监管制度、保障制度,以及专家陪审员参加环境案件审理的相关辅助机制,建议启动专家陪审员参与环境案件审理的相关立法工作。当前情况下可以先制定相关司法解释,为《人民陪审员法》的修改进行相应的立法准备。In order to correctly identify the evidence and facts in the trial of environmental cases and improve judicial credibility,it is suggested to establish a system for expert jurors to participate in the trial of environmental cases.Environmental cases are highly professional,technical and complex.The direct participation by expert jurors in the trial can make up for judges'lack of environmental professional knowledge and solve technical problems in the trial of environmental cases,which is of great significance to scientifically identify the facts of the case,effectively supervise the trial work of the people's court and effectively improve the credibility of environmental justice.Based on the experience of intellectual property trial and the pilot practice of local courts,it is suggested to establish system of expert jurors'selection,trial participation,supervision and guarantee for expert jurors to participate in the trial of environmental cases,as well as the relevant auxiliary mechanism for expert jurors to participate in the trial of environmental cases.It is suggested to start the legislative work relating to the participation of expert people's assessors in the trial of environmental cases.At present,relevant judicial interpretations can be formulated first to make corresponding legislative preparations for the amendment of the People's Assessors Law.
