高校管理中学生隐私权的保护

摘　　要：高校管理权与学生隐私权之间存在着严重的冲突,高校在心理咨询、信息收集、宿舍管理、学生惩戒工作中,可能会侵害到学生的隐私权。文章从法理学和社会背景的角度对高校管理权与学生隐私权之间产生法律冲突的原因进行了分析,指出解决高校管理权与学生隐私权之间的矛盾不仅需要国家、高校、学生的共同努力,还需探索新的学生管理制度。There is a serious conflict between university management right and student privacy right.Colleges and universities may violate students’privacy rights in psychological consultation,information collection,dormitory management and student punishment.From the perspective of jurisprudence and social background,this paper analyzes the reasons for the legal conflicts between university management right and students’right of privacy step by step,and points out that solving the conflicts between university management right and students’right of privacy not only needs the joint efforts of the state,universities and students,but also needs to explore a new student management system.
