摘  要:《行政复议法(修订)(征求意见稿)》的行政复议调解规定拟进一步扩大调解的适用范围,确立"应调尽调"理念,发挥调解在化解行政争议上的优势。诚然,行政参与权理论及诸多实践因素可支持扩张复议调解适用范围的正当性,但基于行政复议之立法目的、嗣后协商余地的有限性及选择适用调解的裁量性,复议机关对调解的适用仍有限度。修法应明确不可调解的情形以及复议机关在选择调解时应予考量的因素。The administrative reconsideration mediation provisions of the Administrative Reconsideration Law(Draft for comments) intend to further expand the scope of application of mediation, establish the concept of maximum mediation, and give play to the advantages of mediation in resolving administrative disputes. It is true that the theory of administrative participation rights and many practical factors can support the legitimacy of expanding the scope of reconsideration and mediation, but based on the legislative purpose of administrative reconsideration, the limited scope for subsequent negotiation, and the discretion to choose to apply mediation, the application of mediation by the reconsideration agency is still limited. The amendment of the law should clarify the circumstances that cannot be mediated and the factors that the reconsideration agency should consider when choosing mediation.
