纠结的“查阅”同步录音录像:新《刑诉法解释》第54条述评

摘　　要：最高人民法院新《刑诉法解释》第54条写明了律师"查阅"讯问录音录像的权利,但就文义解释而言,该规定一方面未能化解长期以来饱受争议的同步录音录像的证据属性问题,另一方面刻意回避了阅卷权下的"复制"权能;由于加设了限制条件,也可能造成在普通刑事侦查案件及监察委负责调查的案件中讯问录音录像的查阅困难。鉴于同步录音录像于当下兼及证明过程合法性以及证据真实性的重要证据地位,应扩大适用范围,保证作为证据的录音录像随案移送,开放多种方式的律师调阅途径,为转变侦查方式、规范办案行为、排除非法证据提供更多可能的空间。That lawyers have the right to “access” audio and video recordings of interrogation is stipulated in the Article 54 of the Interpretations by the Supreme People’s Court Regarding the Application of the Criminal Procedure Law of the People’s Republic of China(2021). However, from the prospective of the literal interpretation, on one hand, this provision fails to resolve the long-time controversy of synchronized audio and video recordings of interrogation as evidence;on the other hand, it deliberately avoids the “copying”right under the right to review case files;the additional restrictions may also cause difficulties in accessing audio and video recordings of interrogation in cases of ordinary criminal investigation and cases investigated by the Supervisory Commission. Considering the significant position of the synchronized audio and video recordings of interrogation as the important evidence of proving the legality of the process and authenticity of the evidence, it is necessary to expand the scope of application of the audio and video recordings of interrogation, which is made sure to bo transferred along with the case, and to develop various ways for lawyers to access such evidence. It provides more possibilities for changing methods of investigation,standardizing case handling, and excluding illegal evidence.
