论事故调查报告证据能力问题——以新《刑诉法解释》第101条为中心

摘　　要：事故调查报告是对安全事故等发生的原因、经过、责任认定、处理建议等的综合性意见,在刑事诉讼中判断其证据能力时,面临事故调查主体缺乏刑事调查权、事故调查程序规范化不足和事故调查报告难以归入法定证据种类等争议。2021年最高人民法院新《刑诉法解释》第101条是事故调查报告的证据能力规范,对事故调查报告的规范运用有重要意义。应当对事故调查报告与其所附证据材料的证据能力问题作出区分。对事故调查报告证据能力应当严格审查,从事故调查主体中立性、调查人员专业性、调查程序正当性、调查结论可靠性等方面进行。An accident investigation report provides comprehensive opinions regarding to safety accidents and other accidents on the cause,process,responsibility determination,handling suggestions,etc..When judging the competency of an accident investigation report in criminal proceedings,several disputes would surface,including the agency in charge of the accident investigation lack of criminal investigative power,insufficient standardization of accident investigation procedure and the failure for the report to be included in the statutory evidence types,and so on.Aiming at regulating the competency of the accident investigation report,the Article 101 of the Interpretations of the Criminal Procedure Law of the Supreme People’s Court in 2021 has great significance to the reasonable application of the report in criminal procedure.A distinction should be made between the competency of accident investigation report and that of the accompanying evidentiary materials.The admission of accident investigation report shall be strictly reviewed,in the aspects such as the neutrality of the agency in charge of the accident investigation,the competence of the investigators,the legitimacy of the investigation procedures,and the reliability of the investigation conclusions.
