摘 要:《民法典》中关于居住权的规定较为原则与概括,不能适应复杂的实践需要。相较于合同方式,民法典对以遗嘱方式设立居住权的规定更为简略,如何判断遗嘱中设立居住权意思表示的成立要件,意思表示冲突、意思表示附条件或附期限等问题,均属以遗嘱方式设立居住权面临的独特性问题。以居住权的理论和一般规定为依据,结合继承制度的理论和规定,对以遗嘱方式设立居住权的特殊问题予以探讨,可以丰富和完善民法典的居住权规则,让居住权制度更好地发挥效用。The provisions on the residential right in the civil code are relatively general and principled,and can not meet the complex needs of practices.Compared with the way of contract,the provisions of the civil code on the establishment of the residential right by the will are simpler.How to judge the elements of the establishment of the will to establish the residential right,the conflict of the will,the conditional or time limit of the will are the unique problems faced by the establishment of the residential right by will.Based on the theory and general provisions of the residential right,combined with the theory and provisions of the inheritance system,this paper discusses the special problems of establishing the residential right by will,in order to enrich and improve the rules of the residential right in the civil code and make the system of the residential right more effective.
