民族地区民事习惯嵌入乡村治理经验与模式研究——从甘肃民族地区几例民事习惯现存样态谈起

摘　　要：为探寻民事习惯究竟如何嵌入甘肃民族地区乡村治理而实现治理目的,以数个典型案例为切入点分析了民事习惯的静态表达和动态展演。民族地区民事习惯嵌入乡村治理自身应具备不违反法律法规、不违背公序良俗、获得民众认可与遵循等三个要素;通过调解、诉讼、诉调对接形式联动适用于乡村纠纷化解;在情理法互润与协调中通过自治深化、德治实化、法治强化民事习惯的乡村治理功效。In order to explore how civil customs are embedded in rural governance in minority areas of Gansu to achieve the purpose of governance,the current paper takes several typical cases as the starting point and analyzes the static expression and dynamic performance of civil customs. The use of civil customs in ethnic minority areas in rural governance includes three elements: not violating laws and regulations,not violating public order and good customs,and being recognized and followed by the people;it is applicable to the resolution of rural disputes through the linkage of mediation,litigation and litigation mediation;and in the mutual enrichment and coordination of reason and law,the rural governance effect of civil customs could be strengthened through the deepening of autonomy,the implementation of rule of virtue and the rule of law.
