摘　　要：解决检察机关就同一犯罪嫌疑人部分涉嫌犯罪的事实不起诉是否需要作出不起诉决定的问题,首先,要明确刑事诉讼中审查起诉的客体是案件,而案件的识别标准应当是能否导致公诉权的发动,公诉权的发动包含提起公诉和作出不起诉决定两个层面,不起诉的部分事实也能构成审查起诉的客体。其次,检察机关作出不起诉决定会受到侦查机关、监察机关和当事人的制约,相关主体相应的监督和救济路径应当得到保障。最后,审查起诉的错案预防功能、公诉权的专属性、法律规范的体系性以及公诉与自诉的衔接问题都是对相关规范进行解释时所必须考虑的具体问题。基于多方面的考察,对部分事实起诉的同时也应当对不起诉的部分事实所形成的案件作出不起诉决定。To solve the problem whether the procuratorial agencies need to make the decision not to prosecute the same criminal suspect on some facts that are not prosecuted,firstly,it is necessary to distinguish the object of the prosecution,and the object of prosecution in criminal proceeding are the cases.The identification for a case is based on whether it can lead to the initiation of public prosecution power,which includes prosecuting and making the decision not to prosecute,and the part of facts that are not prosecuted can also become the object in the criminal proceeding.Secondly,the procuratorial agency's decision not to prosecute is under the supervision of the investigative agencies,the supervisory agencies and the litigants,and the corresponding supervision and relief paths of related subjects should also be guaranteed.Finally,the prevention of misjudged cases,the exclusive nature of the power of prosecution,the system of legal norms,and the connection between public prosecution and private accusation are all specific issues that must be considered when interpreting relevant norms.Based on all aspects of the investigation,this paper draws a conclusion that when a part of facts are prosecuted,the decision not to prosecute should also be made on the part of facts that are not to be prosecuted.
