环境法的性质定位:认知焦虑、理性回归及归位效应

摘　　要：以调整对象及调整方法的部门法划分为标准,形成了"行政法说""经济法说""社会法说""独立部门法说"等有关环境法性质定位的传统学说,造成了环境法的性质定位认知焦虑。基于对传统部门法理论下环境法性质定位困局的反思,又形成了"行业法说""边缘法说""交叉法说"等有关环境法性质定位的新兴学说,同样给环境法的性质定位造成了认知焦虑。其中,"领域法说"提出的"领域法"概念则为纾解环境法性质定位的认知焦虑提供了必要而妥适的解决思路,从而使得环境法的性质定位认知有了真正的理性回归。对环境法的领域法性质定位之归位效应的思察集中表现在两个方面:一方面,环境法作为领域法的性质定位对生态文明时代的环境法学体系产生重大影响,有利于构建一个全方位、宽领域、多要素的"三位一体"的环境法学体系,从而为我国环境法学之学科体系、学术体系和话语体系的建立健全与完善发展提供必要的理论基础。另一方面,环境法作为领域法的性质定位对生态文明时代的环境法治体系产生重大影响,主要体现在统合环境立法、综合环境执法、集合环境司法、全民环境守法等多个环境法治环节,进而影响我国"多元共治与多规范协同"的、"四位一体"的环境法治体系工程建设与发展的基本方向。The traditional theories regarding the qualitive orientation of environment law, according to the division of the departmental law of adjustment object and method, forms different schools such as "administrative law theory", "economic law theory", "social law theory" and "the law of independent department",resulting in cognitive anxiety regarding the qualitive orientation of environment law.Besides, based on the reflection on the dilemma of the qualitive orientation of environmental law under the traditional departmental law theory, some emerging theories such as "industrial law theory", "marginal law theory", "cross law theory",have been formed, which also arises cognitive anxiety regarding the qualitive orientation of environmental law.However, among those theories, the concept of domain law proposed by "domain law theory" provides a necessary and appropriate solution to relieve the cognitive anxiety mentioned above, leading to the true rational regression of the cognition concerning the qualitive orientation of environmental law.There are two aspects to reflect on the homing effect of the qualitive orientation of the domain law as the environmental law: the environmental law with its qualitive orientation as a domain law, exerting a great influence on the environmental law system in the era of ecological civilization, contributes to build a comprehensive, broad and multi-factor environmental law system, thus to provide the necessary theoretical basis for the establishment and improvement of the discipline, academic and discourse system of environmental law in China.Besides, the qualitive orientation of environmental law as a domain law has a great impact on the environmental rule of law system in the era of ecological civilization, in terms of aspects such as the integration of environmental legislation, comprehensive environmental law enforcement, integrated environmental justice, all people abiding by the environment law and so on, therefore to influence the basic direction of construction and development of
