摘　　要：宅基地资格权作为宅基地"三权分置"政策的重要内容,承载着保障农民居住权益的特殊功能。随着城乡融合发展进入新的历史阶段,由"一户一宅"向"户有所居"的制度性调整为宅基地资格权的多样化实现提供了重要依据。梳理宅基地资格权的形成历程,明晰宅基地资格权的内涵和定位,能更好地理解宅基地"三权分置"政策提出的历史背景;正视宅基地资格权在理论上的不足与实践中的混乱,能够有效完善宅基地资格权的权能构成;通过类型化分析宅基地资格权在实践中的不同表现形式,能够为"户有所居"的有效实现提供必要的基础支撑。As an important part of the"Separation of Three Rights"policy of homestead,homestead qualification right carries the special function of protecting farmers’living rights and interests.With the development of urban-rural integration entering a new historical stage,the institutional adjustment from"one household one house"to"one household has residence"provides an important basis for the diversification of homestead qualification right.Combing the formation process of homestead qualification right and clarifying the connotation and positioning of homestead qualification right can better understand the historical background of the"separation of three rights"policy of homestead base;Facing up to the deficiency in theory and the confusion in practice of homestead qualification right can effectively improve the power structure of homestead qualification right;By analyzing the different forms of homestead qualification right in practice,it can provide necessary basic support for the effective realization of"household ownership".
