摘  要:由于劳资关系的从属性特征,加之传统隐私权保护模式有其局限性,因此,有必要对劳动者的隐私权进行特殊保护。劳动者隐私权保护有助于实现劳动者平等就业权、言论自由权以及矫正其弱势地位。然而,由于契约自由与附随义务的限制,劳动者隐私权在一定范围之内应让步于雇主合法利益。在平衡劳资利益的过程中,应当考虑劳动者合理期待的需求,并以比例原则作为核心适用原则,在遵循合法合理原则的基础上,平衡劳资关系。Due to the subordination characteristics of labor-capital relations and the limitations of the traditional mode of privacy protection,it is necessary to give special protection to workers privacy right.The protection of workers right to privacy is helpful to realize their equal right to employment,right to freedom of speech and correct their weak position.However,due to the limitation of freedom of contract and collateral obligation,the right of privacy of workers should be compromised to the legitimate interests of employers in a certain extent.In the process of balancing the interests of labor and capital,we should consider the reasonable expectation of workers,take the principle of proportion as the core applicable principle,and balance the labor relations on the basis of following the legal and reasonable principle.
