强奸罪不能纳入告诉才处理案件的范围——对娱乐圈性侵事件的反思

摘　　要：我国告诉才处理案件属于自诉案件中的一类,需要由自诉人推动案件的全过程。告诉才处理案件在我国有一定的社会根基,确立其范围的基本思想包括轻微思想、和解思想和隐私思想。从社会功能方面和立法原义方面来看,告诉才处理案件都并不必然等于自诉案件。强奸罪因侦查取证难度大等自身性质的原因而不适合纳入告诉才处理案件的范围;即便对告诉才处理案件的救济方式进行改革,将强奸罪纳入其中也不利于对被害人的特别保护。In China,to be handled only upon complaint cases belongs to the category of private prosecu-tion cases,and the whole process of the case needs to be promoted by the private prosecutor.Cases of tobe handled only upon complaint has a certain social foundation in China,and the basic ideas for establish-ing its scope include slight thoughts,reconciliation thoughts,and privacy thoughts.From the perspective ofsocial function and the original meaning of legislation,it is not necessarily equal to private prosecution cas-es.The crime of rape is not suitable to be included in the scope of to be handled only upon complaintcases due to its own nature such as difficulty in obtaining evidence.Even if the remedy for it is re-formed,the inclusion of the crime of rape is not conducive to the special protection of victims.
