论乡村振兴背景下农民户有所居的住房保障

摘　　要：在实施乡村振兴战略的背景下,农村宅基地制度存在的矛盾和问题可以通过户有所居的农民住房保障得以解决。应当在尊重农民意愿和符合规划管理的前提下,综合保障农民住房、振兴农村产业和严格保护耕地的需要,将户有所居作为保障农民住房、实现土地集约节约利用的方式,不仅在城镇规划区重点推行,而且也可以因地制宜、尊重农民意愿,严格地在乡村实行。适应户有所居的住房保障改革,应当建立和完善村庄规划制度、农民住宅建设用地集体所有权制度、农民住宅集体建设用地使用权制度、农民户有所居购房资格权制度、农民户有所居房屋所有权制度等法律制度。Under the background of rural revitalization strategy, the contradictions and problems existing in the rural homestead system can be solved through the housing security of peasants with household ownership. On the premise of respecting the wishes of peasants and conforming to the planning and management, with comprehensive consideration of ensuring the needs of peasants’ housing, revitalizing rural industries and strictly protecting cultivated land, and take household ownership as the guarantee of peasants’ housing the way to realize the intensive and economical use of land, household ownership should be implemented not only in urban planning areas, but also in rural areas according to local conditions, respecting peasants’ wishes and strict management. To adapt to the housing security reform of household ownership, we should establish and improve the following legal system including the village planning system, the collective ownership system of peasants’ housing construction land, the use right system of peasants’ housing collective construction land, the qualification system of peasants’ housing purchase, the ownership system of peasants’ housing and other legal systems.
