摘　　要：行政违法检察监督将检察机关的法律监督范围从诉讼领域向诉讼领域外拓展,丰富了检察权的内容。行政违法检察监督符合法律监督基本原理。检察权介入对行政行为的监督,这符合当下依法治国和国家治理体系现代化建设的需要。行政违法检察监督仍然具有检察权的“法律监督”属性,监督的对象、权力性质和监督原则都有限度。当前实践运作中,需要从线索来源、监督范围、监督方式上进行探索,尤其要处理好与现有检察制度设计的衔接,同时强化机制保障,建立案件化办理机制、检察一体化机制和外部协作机制,以实现检察监督的规范化运行。Administrative illegal procuratorial supervision expands the scope of legal supervision of procuratorial organs from the litigation field to outside the litigation field, and enriches the content of procuratorial power.The procuratorial supervision of administrative violations is in line with the basic principles of legal supervision.It should be involved in the supervision of administrative acts, which is in line with the needs of the current rule of law and the modern construction of national governance system.The procuratorial supervision of administrative violations still has the attribute of “legal supervision” of procuratorial power, and the object, nature and principle of supervision are limited.In the current practical operation, we need to explore the clue source, supervision scope and supervision mode, especially deal with the connection with the design of the existing procuratorial system, strengthen the mechanism guarantee, and establish the case handling mechanism, procuratorial integration mechanism and external cooperation mechanism, so as to realize the standardized operation.
