摘  要:高校与学生之间因教育、管理与服务而形成的关系,并非单一的行政管理关系或者契约关系,而是涵摄道德、法律、伦理、管理等各种因素在内的多维度、多向度的关系"场"。传统的"校生关系"范式存在固有缺陷,缺乏自我反思精神,不可避免地造成了高校与学生之间的冲突与张力。当前"校生关系"中虚假商谈问题突出,是二者张力不能有效纾解的症结所在。哈贝马斯商谈理论去除自我中心主义,尊尚平等与理解的主体间性,给处于困境中的"校生关系"范式重构提供了一条可以研究与探索的路径。通过主体间的开放性商谈与言语行为的有效性商谈,寻求相互之间的理解,充分沟通与论辩,最大限度地促成双方都可以接受的商谈结果。对于虚假商谈的行为,在诉讼中将受到不利司法评价。The relationship between universities and their students formed by education,management and service is not a single administrative relationship or contractual relationship,but a multi-dimensional relationship“field”which contains various factors such as morality,law,ethics,management and so on.The traditional paradigm of“University and Student”relationship has inherent defects and lacks the spirit of self-reflection,which inevitably leads to the conflict and tension between university and students.At present,the problem of false discourse in the relationship between university and learning is prominent,which is the crux of the tension.Habermas’theory of discourse removes ego-centrism,respects the inter-subjectivity of equality and understanding,and provides a research and exploration path for the reconstruction of the paradigm of the relationship between university and students.Through the open negotiation between subjects and the effective negotiation of speech acts,we can seek mutual understanding,fully communicate and argue,and promote the negotiation results acceptable to both sides to the greatest extent.The behavior of false negotiation will be subject to adverse judicial evaluation in litigation.
