摘 要:自我国《劳动合同法》正式建立起经济性裁员制度以来,企业经济性裁员现象随着市场经济的深入发展变得越发频繁。我国的经济性裁员制度在裁员程序、被裁劳动者劳动权利保障以及法律责任等方面也逐渐完善,但是现行的经济性裁员制度在以上各个方面存在着诸多不足。针对这些不足,应完善经济性裁员制度,以寻求经济性裁员过程中企业的自主经营权和劳动者的合法劳动权益之间的平衡。Since China formally established the economic redundancy system through passing The Labor Contract Law,the phenomenon of economic redundancy has become more and more frequent with the in-depth development of the market economy.The condition,procedures of layoffs and the right system of laborers is becoming more and more mature.However,the deficiencies exist in the current economic layoff system in many aspects.Based on these deficiencies,some legislative proposals at the institutional level for improving the economic redundancy system are put forward to seek the balance between the independent management right of businesses and the protection of laborers’legal rights.
