摘 要:农村宅基地集体所有的制度框架形成于人民公社时期。当时的泛公有化思想是推动宅基地集体化的重要因素,但集体土地对农民户有所居的保障也是宅基地集体所有的重要成因,并更进一步构成了宅基地集体所有的正当性基础。当前,改革农村宅基地制度的基础性工作是实现宅基地集体所有的民法表达,完善其民法构造。相关法律应科学界定农村集体组织的宅基地所有权,使其区别并独立于村民自治权和政府管理权。同时,还应明确集体组织对集体成员的建房用地保障责任,正面规定集体成员的宅基地取得权或资格权,充实宅基地集体所有的内部法律关系。The institutional framework of collective ownership of rural homestead was formed in the period of people’s commune.At that time,although the thought of pan-public ownership was an important factor in promoting the collectivization of homestead,the guarantee of collective land for farmers’living was also the important factor that further constituted the legitimacy foundation of collective ownership of homestead.At present,the basic work of reforming the rural homestead system is to realize the civil law expression of collective ownership of homestead and improve its civil law structure.The compilation of the Civil Code should scientifically define the ownership of rural collective organization’s homestead,so as to make it different and independent from the villagers’autonomy and the government’s management.At the same time,we should also make clear the responsibility of collective organizations to protect the construction land of collective members,positively stipulate the right to acquire the homestead of collective members,and enrich the internal legal relationship of collective ownership of homestead.
