摘　　要：检察听证制度,是检察机关践行以人民为中心的发展思想,引导人民有序参与司法的重要制度设计。该制度充分体现了检察制度的人民性,契合人民参与司法的时代诉求,符合构建人民信赖司法体系的现实需要,顺应检察权运行诉讼化构造的发展趋势。近年来,最高人民检察院大力推行检察听证制度,颁布《人民检察院审查案件听证工作规定》,提出“应听证尽听证”的工作要求,检察听证制度得到里程碑式的发展。然而,从实践运行状况看,检察听证制度仍存在一些不足和需要进一步完善之处。对此,要保障听证员选用的民主代表性,加大基层普通民众担任听证员的比例;以诉讼经济原则规范检察听证启动,合理界定听证适用范围;以诉讼化运作完善检察听证细则,健全听证配套机制建设;以强制反馈机制强化检察听证意见运用,赋予听证意见更强的法律效力。The procuratorial hearing system is an important development concept for the procuratorate to practice the people-centered jurisprudence and guide the people’s orderly participation in justice.In recent years,the SPP has vigorously promoted the procuratorial hearing system,promulgated the Regulation on the People’s Procuratorate Hearing Work regarding Case Review and required that hearing be conducted as much as possible.The procuratorial hearing system has hence achieved a milestone development.However,from the practical perspective,the procuratorial hearing system still has some shortcomings and needs further improvement.In this regard,it is necessary to ensure the democratic representation of hearing officers and increase the number of ordinary people.We should standardize the initiation of procuratorial hearings with the principle of“litigation economy”,and reasonably define the scope of application of hearings.We should improve the detailed rules of procuratorial hearings and improve the construction of supporting mechanisms for hearings.We should also strengthen the operation of procuratorial hearing opinions with mandatory feedback to give the hearing opinion a stronger legal effect.
