摘 要:法治国家的基本要义之一在于维系法的安定性,就公民而言,主要体现为对信赖利益的保护。无论是坚持信赖保护原则构成的三要件论还是四要件论,当该原则介入行政审判领域时,均需在信赖利益与公共利益之间进行权衡。法益衡量具有必然性,这既取决于利益冲突的客观现实,也是信赖保护原则自身的内在要求。构建针对信赖保护原则的法益衡量基准,需要考虑诸多要素,包含但不限于:保障基本权利原则、行政行为的种类与成立方式、信赖利益对相关主体的影响程度、行政行为本身的违法程度、行政行为作出后的持续效果。One of the basic principles of a country ruled by law is to maintain the stability of law.As far as citizens are concerned,it mainly embodies the protection of trust interests.Whether it is the theory of three elements or four elements of the principle of trust protection,when the principle is involved in the field of administrative trial,it is necessary to weigh the trust interest and public interest.The measurement of legal interest is inevitable,which depends on the objective reality of interest conflict and the inherent requirement of the principle of trust protection.In order to construct the legal interest measurement standard against the principle of trust protection,we need to consider many factors,including but not limited to:the principle of protecting core rights,the types and establishment methods of administrative acts,the influence of trust interests on relevant subjects,the illegality degree of administrative acts themselves,and the continuous effects of administrative acts.
