摘　　要：为落实新修订的著作权法规定的传播录音制品获酬权,我国应对其实行强制集体管理,以更好地兼顾录音制品权利人与录音制品播放者之间的利益关系。与此同时,鉴于录音制品的传播与音乐作品著作权的行使密不可分,对传播录音制品获酬权的强制集体管理与音乐作品著作权集体管理往往相互交织,出于简化交易环节的考虑,应当由音乐著作权集体管理组织一并负责传播录音制品报酬的收取工作。而在录音制品报酬的分配管理方面,出于无法准确监测、收集录音制品播放数据的现实考虑,集体管理组织应当以趋近公平为目标,加强对报酬分配工作的精细化管理,同时还应创设更具开放性和参与性的监督约束机制,避免分配管理活动成为黑箱。In order to implement the right to remuneration for dissemination of sound recordings as stipulated in the newly revised Copyright Law, China should implement compulsory collective management to better balance the interests of the right holders of sound recordings and the players of sound recordings. At the same time, in view of the inseparable relationship between the dissemination of sound recordings and the exercise of copyrights in musical works,the compulsory collective management of the right to remuneration for dissemination of sound recordings and the collective management of copyrights in musical works are often intertwined. For the sake of simplifying the transaction process, the collective management organization of music copyright should be responsible for the collection of remuneration for dissemination of sound recordings. On the other hand, in terms of the management of the distribution of remuneration for sound recordings, due to the inability to accurately monitor and collect the playback data of sound recordings, the collective management organization should aim to approach fairness and strengthen the fine management of the distribution of remunerations. Meanwhile, it is also necessary to create a more open and participatory supervision and restraint mechanism to prevent the distribution and management activities from becoming a black box.
