摘　　要：社会发展引发了与物权紧密相关的诸多重大疑难问题,它们为深度透视物权法基础理论提供了新平台,又为拓展物权法的体系效用提出了新要求。以物权法为原点,以体系关联为主线,能逐层看到以下典型问题:①物权法对数据赋权模式的意义何在;②如何借助民法总论和法理学的知识丰富对政策等物权习惯法的认知;③怎么厘定物权法和合同法交错下的合同对抗力的底层逻辑;④家庭财产法中父母和未成年子女之间的物权归属和处分规则是什么;⑤解读商事担保物权规范应如何对待民法制度逻辑;⑥怎样辨析行政许可和物权变动的关系;⑦如何确定司法查封对物权限制的路径;⑧工业革命基因的物权法怎么因应信息革命的科技变迁。对这些源自实践的问题的纵深探讨,会促成物权法学理的进一步发展,为此要深度挖掘物权法的基本制度功能,要贴近实践找出事物发展规律,要进行有效的跨学科交融。It is believed that the development of the society leads to many major problems relating to property, which provides new platforms for the research on fundamental theories in property laws and needs new requirements for the utility of property law system. With the analysis of property law as the origin and the relationships between legal systems, this article analyses following typical issues layer by layer. 1. What is the meaning of the mode of empowerment for data by the property law? 2. How to enrich the recognition of customary law in property by the knowledge of general theories in civil laws and jurisprudence? 3. How to explain the underlying logic for the confrontation effect of contracts by theories between property laws and contract laws? 4. What are the ownership and disposition rules between parents and children in family property laws? 5. How to explain commercial security rules under the logic in civil law systems? 6. What is the relationship between administration licensing and changes in property rights 7. How to clarify the path for judicial seizure to restrict property rules 8. For the property law with genes of industrial revolution, how to deal with changes caused by technique development in information revolution? It is undeniable that deep discussions for these problems from practices would lead to the development for property law theories. Therefore, it needs to analyze fundamental functions in legal systems for property laws deeply, discover the development rules by the closing recognition of practices and make interdisciplinary researches efficiently.
