检察官在量刑建议制度中的角色定位探究

摘　　要：量刑建议是支撑认罪认罚从宽制度运行的主线,其实践方式决定着认罪认罚从宽制度的整体样态。在当前的司法实践中,从量刑建议的协商到量刑建议的落实,检察官希望全过程强势主导,从而与辩方、法官在诉讼职能上形成碰撞。这种碰撞冲击着我国刑事诉讼的基本结构,既潜伏着检察官滥用权力、辩护权严重受损的风险,也可能重塑量刑权分配的传统格局,对司法最终裁决原则提出挑战。重塑量刑建议制度中控辩审之间的良性关系,需检讨当前量刑建议制度实践及完善量刑建议制度对策的底层逻辑,检察官在量刑建议制度中的角色定位应从量刑建议制度的主导者向量刑建议的释明者转换。Sentencing recommendations are the principal line supporting the operation of the leniency system for admitting guilt and accepting punishment,and its practice way determines the overall state of the leniency system for admitting guilt and accepting punishment.In the current judicial practice,from the consultation of sentencing recommendations to the implementation of sentencing recommendations,prosecutors hope to be a strong leader in the entire process,thus form a collision with the defense and judges on the litigation functions.This collision impacts the basic structure of our country’s criminal procedures,which not only has a lurking risk that prosecutors abuse their power and the right of defense is seriously damaged,but also possibly reshapes the traditional distribution pattern of the sentencing power and challenges the principle of judicial final adjudication.The reconstruction of a positive relationship among the prosecution,the defense,and the judges in the sentencing recommendation system requires a review of the current practice of the sentencing recommendation system and the underlying logic of the proposals on perfecting the sentencing recommendation system.The positioning of prosecutors’role in the sentencing recommendation system should be transformed from the leader of the sentencing recommendation system to the interpreter of sentencing recommendations.
