涉外法治人才培养中法律文书写作的教学改革

摘　　要：国内外形势的变化以及多个世所瞩目的涉外案件的发生,都印证了涉外法治人才培养的急迫性,我国对于法律文书写作教学也提出了新的改革要求。这主要反映在要求法律文书写作教学具备国际视野与多学科思维,承载中国话语对外输出的重要使命,并且以产出导向回应司法体制改革。新时期的法律文书写作教学改革容易陷入的误区包括:未准确定位文书写作与案例分析的关系,夸大人工智能在法律文书写作中的作用,忽略对法律文书最新发展动向的追踪等。教学改革的具体方向为:一方面,增加涉外法律文书写作赏析以及公关技巧讲解;另一方面,明确课程考核的重点是写作技能,考核的文书种类主要是法院文书与律师实务文书,不讲解、不考核与写作关联度较低的内容。The changes in the domestic and international situation and the occurrence of many foreign-related cases that have attracted worldwide attention have confirmed the urgency of cultivating foreign-related rule-of-law talent,and has also put forward new reform requirements for the teaching of legal document writing.This is mainly reflected in the requirement that the teaching of legal document writing need to have an international perspective and multidisciplinary thinking,which bears the important mission of Chinese discourse to the outside world,and responds to the reform of the judicial system with output orientation.The misunderstandings that are easy to fall into in the reform of legal document writing teaching in the new era,including:not accurately positioning the relationship between document writing and case analysis,exaggerating the role of artificial intelligence in legal document writing,and ignoring the tracking of the latest developments in legal documents.The specific directions of the teaching reform are:on the one hand,increase the appreciation of foreign-related legal document writing and public relations skills;on the other hand,it is clear that the focus of the course assessment is writing skills,and the types of documents to be assessed are mainly court documents and lawyers'practical documents.Content that is less relevant to writing is not assessed.
