摘 要:网约车司机的劳动既有平台用工的特殊性,也与传统出租车司机的劳动具有同质性。网约车平台企业虽然在经营模式上与传统出租车企业存在差异,但在本质上两者同属于出租车经营者。比照传统出租车司机和企业之间的关系,网约车司机和平台企业之间的关系应当以劳动关系为一般,以非劳动关系为例外。法律应当承认出租车司机劳动的特殊性和网约车司机劳动的灵活性,在确认双方之间劳动关系的基础上,通过非标准工时、特殊的社会保险等制度安排,保护包括网约车司机在内的出租车司机的权益。对于无法建立劳动关系的网约车司机,通过特殊立法保护其权益是现实可行的选择。The work of online ride-hailing drivers has the particularity of platform service,and it also shares homogeneity with the work of traditional taxi drivers.Although there are differences between online ride-hailing platform companies and traditional taxi companies in terms of their business models,in essence,both of them are taxi operators. In contrast to the relationship between traditional taxi drivers and enterprises, that between online ride-hailing drivers and platform enterprises should be considered as labor relations in general and non-labor relations in exceptional cases. The particularity of the work of taxi drivers and the flexibility of online ride-hailing drivers should be recognized by law. On the basis of confirming the labor relationship,there should be protective arrangements,such as non-standard working hours and special social insurance payments,to protect the rights and interests of taxi drivers including online ride-hailing drivers. For those who cannot establish labor relationships,the special protective legislation would be a realistic and feasible option.
