摘　　要：休息权是我国宪法明确规定的公民的最基本权利,但是在当今社会形势下,却不断地受到挑战,“过劳死”现象屡见不鲜,随着全面小康社会即将建成,人民的物质生活逐渐得到改善的同时,权利意识也在逐渐的得到苏醒,以牺牲劳动者的休息权为代价换取经济的飞速发展在一定程度上是对人权的一种侵害,不符合可持续发展的要求,重视劳动者休息权的保护既体现了对劳动者的人文关怀,也有利于社会的良性发展。休息权从应有权利变为实有权利还有很长的一段路程要走,本文通过对当前劳动者休息权保护的社会现状进行分析,从而提出了一系列完善劳动者休息权的相关措施。The right to rest is the most basic right of citizens as clearly stipulated in the Constitution of our country,but in today's social situation,it is constantly challenged,and the phenomenon of"overwork and death"is common.With the establishment of a well-off society in an all-round way,the people's material life is gradually improved,and the consciousness of rights is gradually revived,and the rapid development of economy at the expense of workers’right to rest is to some extent an infringement on human rights.The right to rest goes from entitlement to entitlement There is still a long way to go,this paper analyzes the current social situation of workers’right to rest protection,and puts forward a series of measures to improve workers’right to rest.
